Consignment Agreement & Terms

At SnagTheBag, we believe luxury resale should feel personal, transparent, and collaborative. Unlike high-volume resale platforms, we take a curated approach to consignment. Each accepted item is individually evaluated, photographed, and presented with detailed descriptions designed to highlight its craftsmanship, condition, and collectibility.

By submitting an item for consignment, you agree to the following terms.

The Consignment Process

1. Overview of Consignment Model

SnagTheBag operates as a curated luxury handbag platform. By consigning with us, you authorize SnagTheBag to:

  • Market and list your item for sale

  • Create photography, descriptions, and editorial content

  • Facilitate transactions with prospective buyers

  • Recommend and implement pricing strategies designed to improve sell-through

Ownership of the item remains with you until it is sold.

2. Eligibility of Items

We accept only authentic luxury handbags and accessories that meet our standards for authenticity, condition, and brand alignment. By submitting an item, you represent and warrant that:

  • You are the legal owner of the item

  • The item is authentic and not counterfeit

  • You have the legal right to sell the item

  • Any information provided regarding the item is accurate to the best of your knowledge

SnagTheBag reserves the right to reject, remove, or return any item at its discretion, including for condition concerns, authenticity concerns, category focus, inventory strategy, or brand alignment.

3. Authentication

All items may undergo an authentication review.

  • Authentication may be performed using internal expertise, third-party authenticators, or both

  • Items determined to be inauthentic will not be listed for sale

  • Consignors may be responsible for authentication-related expenses and return shipping costs where applicable

While we take authentication seriously, no authentication method is infallible. SnagTheBag is not liable for undisclosed defects, manufacturer variations, or sophisticated counterfeit items that bypass commercially reasonable authentication practices.

4. Pricing & Listing

We work collaboratively with consignors to determine an initial listing price based on market conditions, item condition, rarity, and recent comparable sales.

You authorize SnagTheBag to:

  • Create and publish listings, photographs, descriptions, and editorial content

  • Adjust pricing based on market demand, seasonality, listing performance, or changing market conditions

  • Promote the item across SnagTheBag marketing channels

While SnagTheBag retains authority to manage pricing, significant pricing adjustments may be discussed with the consignor when practical.

5. Commission & Payouts

Commission rates are determined based on the final selling price of the item.

Current commission structure:

  • Items sold for less than $5,000: 30% commission (70% payout)

  • Items sold between $5,000 and $10,000: 25% commission (75% payout)

  • Items sold above $10,000: 20% commission (80% payout)

SnagTheBag reserves the right to offer alternative commission structures for exceptional items, rare collectibles, estate collections, or high-volume consignors.

Commission percentages are calculated using the final selling price before applicable taxes and shipping charges.

Payments are typically issued within 7–14 business days following completion of the transaction and confirmation that buyer funds have cleared. Payments may be made via bank transfer, PayPal, or another mutually agreed payment method.

While SnagTheBag sales are generally final, returns may be approved in limited circumstances, including verified authenticity concerns or material discrepancies from the original listing.

In such cases, SnagTheBag reserves the right to reverse funds previously paid to a consignor. Returned items may be re-listed or returned to the consignor.

6. Shipping & Risk of Loss

You are responsible for safely shipping your item to SnagTheBag unless otherwise arranged.

For qualifying consignments, SnagTheBag may provide prepaid or complimentary shipping labels at its discretion. Eligibility may vary based on item value, brand, location, or other factors.

Where SnagTheBag advances shipping costs on behalf of a consignor, such costs may be deducted from the consignor's final payout and will be disclosed where applicable.

We recommend using insured and trackable shipping methods for all consignor-submitted items.

Risk of loss remains with the consignor until the item has been received and accepted by SnagTheBag.

Once received and accepted, SnagTheBag assumes responsibility for reasonable care while the item remains in our possession.

7. Storage & Care

We agree to store and handle items using commercially reasonable standards consistent with luxury resale practices.

While an item is in our possession, SnagTheBag will:

  • Store items in a clean, climate-conscious indoor environment

  • Take reasonable precautions against excessive humidity, direct sunlight, and temperature extremes

  • Handle items with care during inspection, photography, listing, storage, packaging, and shipment

You acknowledge that certain materials, including leather, suede, exotic skins, and hardware, naturally age and may respond to environmental conditions over time.

Minor changes such as softening, creasing, patina development, or slight hardware wear may occur despite reasonable care.

SnagTheBag will be liable for loss or damage resulting directly from gross negligence or willful misconduct while an item is in our possession.

SnagTheBag is not liable for:

  • Normal wear and tear

  • Natural material aging

  • Minor handling effects associated with ordinary consignment activities

  • Gradual environmental effects despite reasonable storage practices

  • Events beyond our reasonable control, including theft, fire, flood, natural disasters, or carrier-related incidents

SnagTheBag may, but is not obligated to, maintain insurance coverage for items in its possession. Any such coverage remains subject to policy limitations, exclusions, and insurer determinations.

8. Returns & Buyer Disputes

If a buyer returns an item:

  • The item may be re-listed unless otherwise requested by the consignor

  • The item may be re-evaluated if authenticity concerns are raised

  • SnagTheBag reserves the right to investigate and resolve buyer disputes in a manner it believes protects the integrity of the platform

9. Consignment Period & Withdrawal

The standard consignment period is 60 days unless otherwise agreed. If a consignor requests the return of an item before the end of the consignment period:

  • The item must not be involved in an active transaction, pending sale, buyer review period, dispute, or return process

  • Return shipping, insurance, and related handling costs may apply

  • Applicable costs may be deducted from the consignor's final payout or invoiced separately

SnagTheBag may also return items that no longer align with platform standards, category focus, authenticity requirements, or inventory strategy.

10. Unsold Items

If an item remains unsold near the end of the consignment period:

  • SnagTheBag may recommend pricing adjustments based on market activity

  • The consignor may elect to extend the listing period

  • The consignor may request return of the item

Our goal is to work collaboratively to determine the most appropriate path forward.

11. Representations & Liability

You agree to indemnify and hold harmless SnagTheBag from claims, damages, losses, expenses, or disputes arising from:

  • Ownership disputes

  • Authenticity issues

  • Misrepresentation of item condition

  • Breach of this Agreement

12. Limitation of Liability

To the fullest extent permitted by law, SnagTheBag shall not be liable for:

  • Loss of potential resale value

  • Market fluctuations

  • Lost profits or opportunities

  • Indirect, incidental, special, or consequential damages

13. Termination

SnagTheBag reserves the right to terminate this Agreement at any time and return an item to the consignor.

14. Governing Law

This Agreement is governed by the laws of the State of California, without regard to its conflict of law principles.
