Consignment Agreement & Terms

This Consignment Agreement ("Agreement") is entered into between SnagTheBag ("we," "us," or "our") and the individual or entity consigning items ("you," "Consignor"). By submitting an item for consignment, you agree to the following terms.
1. Overview of Consignment Model
SnagTheBag operates as a curated luxury handbag platform. By consigning with us, you authorize SnagTheBag to:
Market and list your item for sale
Set pricing based on market expertise and demand
Facilitate transactions with buyers
Ownership of the item remains with you until it is sold.
2. Eligibility of Items
We accept only authentic luxury handbags or accessories that meet our standards.
You agree that:
You are the legal owner of the item
The item is authentic and not counterfeit
You have the right to sell the item
SnagTheBag reserves the right to reject any item for any reason, including condition, brand alignment, or authenticity concerns.
3. Authentication
All items may undergo an authentication review.
We may use internal expertise or third-party authenticators
If an item is deemed inauthentic, it will not be listed
You may be responsible for any authentication or return shipping costs
SnagTheBag is not liable for undisclosed defects or sophisticated counterfeit items (super fakes) that bypass standard authentication processes.
4. Pricing & Listing
You authorize SnagTheBag to:
Set or adjust the listing price at any time
Modify pricing based on market demand, seasonality, or performance
Create and publish product descriptions, images, and editorial content
We may consult you on pricing, but final pricing authority remains with SnagTheBag unless otherwise agreed in writing.
5. Commission & Payouts
Upon sale of your item:
SnagTheBag retains a 30% commission percentage of final selling price
The remaining 70% balance is paid to you as the Consignor
Payout terms:
Payments are issued within 14 business days after the transaction and buyer funds can cleared.
Payments may be made via bank transfer, PayPal, or other agreed method
While SnagTheBag sales are often final, in some cases a return may be granted due to material differences or authenticity concerns. In such cases, SnagTheBag reserves the right to reverse funds paid to consignors as a result of these buyer returns — items will then be re-listed for sale or returned to consignor.
6. Shipping & Risk of Loss
You are responsible for safely shipping the item to SnagTheBag unless otherwise arranged.
We recommend insured, trackable shipping
Risk of loss remains with you until the item is received by SnagTheBag
Once received and accepted, SnagTheBag assumes responsibility for reasonable care while the item is in our possession.
7. Storage & Care
We agree to store and handle your item using reasonable standards consistent with luxury resale practices.
While the item is in our possession, SnagTheBag will:
Store items in a clean, climate-conscious indoor environment
Take reasonable precautions to protect against excessive humidity, direct sunlight, and temperature extremes
Handle items with care during photography, listing, and fulfillment processes
However, you acknowledge and agree that:
Certain materials (including leather, suede, exotic skins, and hardware) are inherently sensitive and may naturally respond to environmental conditions over time
Minor changes such as softening, creasing, patina, or slight hardware wear may occur despite reasonable care
SnagTheBag will be liable for loss or damage resulting from gross negligence or willful misconduct while the item is in our possession. However, SnagTheBag is not liable for:
Normal wear and tear or natural material aging
Minor handling effects resulting from standard consignment activities (e.g., photography, inspection, packaging)
Gradual environmental effects that occur despite reasonable storage practices
Loss or damage caused by events beyond our reasonable control, including but not limited to theft, fire, flood, or natural disasters
We may, but are not obligated to, maintain insurance coverage for items while in our possession. Any such coverage is subject to policy terms, limitations, and exclusions.
8. Returns & Buyer Disputes
If a buyer returns an item:
The item will be re-listed unless otherwise requested
If a return is due to authenticity concerns, the item may be re-evaluated
SnagTheBag reserves the right to resolve buyer disputes at its discretion to protect platform integrity.
9. Consignment Period & Withdrawal
The standard consignment period is 60 days unless otherwise agreed.
If you request item return prior to the 60 day standard consignment period or before sale:
A return shipping fee may apply
The item must not be in an active transaction
SnagTheBag may also return items that do not perform or align with platform standards.
10. Unsold Items
If an item does not sell within the consignment period:
We may suggest price adjustments
You may choose to extend the listing or request return
11. Representations & Liability
You agree to indemnify SnagTheBag against any claims arising from:
Ownership disputes
Authenticity issues
Misrepresentation of item condition
12. Limitation of Liability
To the fullest extent permitted by law, SnagTheBag is not liable for:
Loss of potential resale value
Market fluctuations
Indirect or consequential damages
13. Termination
We reserve the right to terminate this Agreement at any time and return your item.
14. Governing Law
This Agreement is governed by the laws of the State of California, without regard to its conflict of law principles.
