Seller Agreements & Terms

These Seller Terms & Conditions (“Agreement”) govern the submission, sale, and/or consignment of items to SnagTheBag (“SnagTheBag,” “we,” “us,” or “our”). By submitting an item for review, sale, or consignment, creating an account, or otherwise engaging with our services, you agree to be bound by this Agreement.

1. Overview

SnagTheBag is a curated platform offering a selective inventory of authentic, pre-owned luxury handbags and accessories. We reserve the right to accept or decline any item, seller, or transaction at our discretion.

Submission of an item does not guarantee acceptance for purchase or consignment.

2. Electronic Acceptance

By submitting an item, creating an account, clicking any acceptance checkbox, or otherwise using SnagTheBag services electronically, you acknowledge and agree that such actions constitute your electronic signature and acceptance of this legally binding Agreement.

3. Seller Representations & Warranties

By submitting an item, you represent and warrant that:

  • You are the lawful owner of the item and have full authority to sell or consign it.

  • The item is authentic and not counterfeit, altered, or unlawfully replicated.

  • The item is free of liens, claims, encumbrances, or ownership disputes.

  • All information provided regarding condition, authenticity, provenance, repairs, modifications, and history is accurate, complete, and not misleading.

  • The item was lawfully obtained and is not stolen or associated with fraudulent activity.

4. Authentication & Inspection

All items are subject to inspection, authentication, and approval upon receipt.

SnagTheBag reserves the right to:

  • Request receipts, serial numbers, identification, certificates of authenticity, or other supporting documentation.

  • Utilize third-party authentication services, including AI-assisted authentication providers, at our discretion.

  • Decline any item that fails to meet our authenticity, condition, or operational standards.

Authenticity determinations are made solely by SnagTheBag and/or its designated authentication partners.

If an item is determined or reasonably suspected to be counterfeit, stolen, materially altered, or otherwise unlawful:

  • The transaction may be canceled immediately;

  • Payment may be withheld or reversed;

  • The item may be returned at seller’s expense;

  • SnagTheBag reserves the right to cooperate with law enforcement or applicable authorities as required by law.

5. Direct Buyout Terms

If SnagTheBag agrees to purchase your item outright:

  • Purchase offers are based on market value, condition, demand, and current resale trends.

  • Quotes are valid for seven (7) calendar days unless otherwise stated.

  • Final offers remain subject to physical inspection and authentication.

  • If the item materially differs from seller disclosures, SnagTheBag may revise or withdraw the offer.

Ownership of the item transfers to SnagTheBag upon issuance of payment.

Payment will generally be issued within seven (7) business days following inspection and final approval.

Once payment has been issued, the transaction is final and the item becomes the sole property of SnagTheBag.

6. Consignment Terms

In select cases, SnagTheBag may offer consignment services.

If accepted for consignment:

  • SnagTheBag will determine listing price, pricing strategy, markdown timing, promotional inclusion, and sales channel placement at its discretion.

  • The consignor will receive seventy percent (70%) of the final net selling price unless otherwise agreed in writing.

  • SnagTheBag retains thirty percent (30%) as commission.

Payouts are generally issued within fourteen (14) business days after:

  • the buyer’s payment has cleared,

  • applicable fraud review periods have passed, and

  • the transaction is considered finalized by SnagTheBag.

During the consignment period:

  • Seller may not list, market, or sell the item elsewhere.

  • Seller retains ownership of the item until sold to a buyer.

  • SnagTheBag may photograph, market, advertise, and promote the item across its website, social channels, marketplaces, and marketing materials.

The standard consignment period is sixty (60) to ninety (90) days unless otherwise agreed.

If the item remains unsold after the consignment term:

  • seller may request return shipment at seller’s expense, or

  • the parties may mutually agree to extend the consignment period.

If a transaction involves:

  • authenticity disputes,

  • chargebacks,

  • fraud investigations,

  • buyer claims,

  • material misrepresentation, or

  • undisclosed defects,

SnagTheBag reserves the right to withhold, reverse, or recover payouts associated with the transaction.

7. Condition & Disclosure Requirements

Seller must disclose all material details regarding the item, including but not limited to:

  • Interior, exterior, corner, glazing, and hardware wear

  • Repairs, recoloring, modifications, or restorations

  • Odors, stains, discoloration, or storage damage

  • Missing accessories, straps, keys, locks, clochette, dust bags, receipts, or packaging

  • Any defects impacting value, function, or authenticity

Failure to disclose material information may result in:

  • revised pricing,

  • cancellation of transaction,

  • denial of consignment,

  • reversal or withholding of payment,

  • return of item at seller’s expense, and/or

  • permanent suspension from selling with SnagTheBag.

8. Shipping & Risk of Loss

Unless otherwise agreed in writing:

  • Seller is responsible for securely packaging all items.

  • Seller bears all risk of loss until the item is received and inspected by SnagTheBag.

  • Shipping costs to SnagTheBag are the responsibility of the seller.

  • SnagTheBag is not liable for items lost, delayed, stolen, or damaged during transit to our facility.

For returned items, risk of loss transfers back to seller upon carrier acceptance.

9. Inventory Insurance & Limitation of Custodial Liability

SnagTheBag may maintain commercial insurance covering certain consigned inventory; however, insurance coverage is not guaranteed for every circumstance or loss.

To the fullest extent permitted by law, SnagTheBag’s liability for any lost, damaged, stolen, or destroyed item shall not exceed the lesser of:

  • the agreed consignment value, or

  • the actual net sale proceeds received by SnagTheBag for the item.

SnagTheBag shall not be liable for:

  • gradual wear,

  • inherent material deterioration,

  • manufacturer defects,

  • force majeure events,

  • acts of third parties,

  • carrier-related losses, or

  • events beyond our reasonable control.

10. Buyer Returns, Claims & Payment Recovery

If a buyer return, payment dispute, chargeback, fraud claim, or authenticity concern arises, SnagTheBag reserves the right to:

  • withhold pending payouts,

  • reverse previously issued payouts,

  • deduct amounts from future seller balances,

  • recover amounts owed using any payment method stored on file,

  • cancel transactions, and/or

  • return items to seller at seller’s expense.

Seller authorizes SnagTheBag to recover any amounts owed under this Agreement through available lawful collection methods.

11. Fraud Prevention & Transaction Monitoring

SnagTheBag reserves the right to refuse, suspend, delay, or cancel any transaction involving suspected:

  • counterfeit goods,

  • stolen merchandise,

  • fraudulent conduct,

  • identity inconsistencies,

  • suspicious transaction patterns, or

  • violations of applicable law.

We may request government-issued identification, proof of ownership, proof of purchase, or additional verification documentation at any time.

12. Pricing & Market Adjustments

Luxury resale market values fluctuate based on demand, condition, seasonality, brand trends, and broader market conditions.

SnagTheBag does not guarantee:

  • sale of any item,

  • any minimum sale price,

  • timing of sale, or

  • estimated resale value.

SnagTheBag retains discretion regarding:

  • pricing,

  • markdowns,

  • promotions,

  • marketplace placement,

  • advertising strategy, and

  • timing of sale.

13. Taxes

Seller is solely responsible for:

  • reporting income,

  • paying applicable taxes,

  • complying with tax obligations, and

  • providing accurate taxpayer information where required.

SnagTheBag may issue tax documentation, including IRS Form 1099s, where legally required.

14. Limitation of Liability

To the fullest extent permitted by law, SnagTheBag shall not be liable for:

  • changes in market value,

  • lost profits,

  • missed resale opportunities,

  • delays in payment processing,

  • consequential damages,

  • incidental damages, or

  • indirect damages arising from use of our services.

In all circumstances, SnagTheBag’s total liability shall not exceed the amount actually paid to seller for the applicable item.

15. Indemnification

Seller agrees to defend, indemnify, and hold harmless SnagTheBag and its owners, employees, contractors, affiliates, and agents from and against any claims, damages, liabilities, losses, costs, or expenses arising out of:

  • seller’s breach of this Agreement,

  • counterfeit or stolen merchandise,

  • inaccurate disclosures,

  • ownership disputes,

  • fraud,

  • violations of law, or

  • third-party claims relating to submitted items.

16. Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to this Agreement or the use of SnagTheBag services shall be resolved exclusively through binding arbitration conducted in Los Angeles County, California.

Seller agrees to waive:

  • the right to a jury trial, and

  • the right to participate in any class action, class arbitration, or representative proceeding.

Arbitration shall be conducted on an individual basis only.

17. Brand Disclaimer

SnagTheBag is an independent reseller and is not affiliated with, endorsed by, or associated with any designer brand featured on the platform.

All trademarks, brand names, logos, and product names remain the property of their respective owners.

18. Governing Law

This Agreement shall be governed by and construed under the laws of the State of California, without regard to conflict of law principles.

19. Modifications to Agreement

SnagTheBag reserves the right to modify or update this Agreement at any time. Updated versions become effective upon posting to the website.

Continued use of SnagTheBag services after updates constitutes acceptance of the revised Agreement.
